Land Registration: The New Law



The Land Registration etc (Scotland) Act 2012 comes fully into force on Monday 8 December. This will mark the biggest change in conveyancing law and practice since the abolition of the feudal system a decade ago. Largely repealing and replacing the Land Registration (Scotland) Act 1979, the 2012 Act introduces a system of land registration which is different in important respects from the current system. As well as the Act itself – at 124 sections and 5 schedules a substantial piece of legislation – there are also new Land Register Rules which include new forms. 


Professor Kenneth Reid and Professor George Gretton were, successively, the Scottish Law Commissioners responsible for designing the new system. In this special three-hour seminar they give authoritative guidance to the Act. By the end of the seminar you will be fully equipped to deal with the changes in law and practice, and to advise clients accordingly.  

Among the many topics covered will be: the background to the legislation; the component parts of the Register, including the Cadastral Map and the Archive Record; advance notices; the effect of registration; the status of entries on the Register; the requirement of a year’s possession; implications for or examination of title; applications for registration; the duty of care to the Keeper; the Keeper’s warranty as to title; inaccuracy and rectification; prescription; a non domino dispositions; caveats; common areas and shared plots; shifting boundaries; deduction of title; specialities for long leases; transitional arrangements; and the ambitious programme for registering every square inch of Scotland, including the new triggers for first registration.


Extensive seminar notes will be provided which will serve as an indispensable guide during the first months of the new system. Styles will be included as appropriate. 

Kenneth Reid is Professor of Scots Law and George Gretton is Lord President Reid Professor of Law, both at The University of Edinburgh.   The seminar will be chaired by Alan Barr, Honorary Fellow at the University of Edinburgh and a partner at Brodies LLP.


Learning Outcomes and Objectives

The learning outcomes and objectives are that (i) by the end of the seminar, participants should have a sound knowledge and understanding of the main changes made to conveyancing law and practice by the Land Registration etc (Scotland) Act 2012; (ii) through the provision of comprehensive written materials, solicitors should be equipped to undertake such further study of the law and practice as they may find necessary or desirable.
